Notice: Personal Property in Public Right of Way

Boards & Committees News Posted on June 03, 2025

When placing fixed structures like fences, rock walls, and stairs on their property, homeowners must stay within the boundaries described in their deed or survey. The public right-of-way may extend beyond the edge of a paved road or sidewalk. Those with properties adjacent to a sidewalk or roadway should take due caution when placing fixed structures near their property boundary. Because the City is responsible for maintaining the right-of-way for the public’s use, the City will defend against any claim made for damaged personal property that was located in the right-of-way, including those alleged to have been caused by a City vehicle while conducting road maintenance. Also, any personal property (grills, sports equipment, fire pits, etc.) placed in the public right-of-way may be removed if the owner has not received prior permission from the Director of Public Works, per City Ordinance. Please call 767-7635 or email publicworks@southportland.org with questions. The City of South Portland cannot provide professional or legal advice regarding your property boundaries.
