When placing fixed structures like fences, rock walls, and stairs on their property, homeowners must stay within the boundaries described in their deed or survey. The public right-of-way may extend beyond the edge of a paved road or sidewalk. Those with properties adjacent to a sidewalk or roadway should take due caution when placing fixed structures near their property boundary. Because the City is responsible for maintaining the right-of-way for the public’s use, the City will defend against any claim made for damaged personal property that was located in the right-of-way, including those alleged to have been caused by a City vehicle while conducting road maintenance. Also, any personal property (grills, sports equipment, fire pits, etc.) placed in the public right-of-way may be removed if the owner has not received prior permission from the Director of Public Works, per City Ordinance.
