2. ORDER #104-24/25 - Authorizing the City Manager to accept delivery of deeds and execute documents for the acquisition of real property at 24R Pilgrim Road from Pilgrim Road LLC. Passage requires majority vote. – PASSED. The City Manager will execute the P&S Agreement and the Assistant City Manager will coordinate with all parties to schedule the closing on or before December 31, 2024.
Providing the sale goes through, the City would acquire 24R Pilgrim Road (Map 23, Lot 10D), a 37+ acre undeveloped parcel adjacent to Hinckley Park. The City’s Open Space Acquisition Committee (OSAC) and City staff inspected and evaluated the property. OSAC voted to recommend acquisition of the land. $1.5M from the City's Open Space Fund, which is funded by a bond voters approved in 2021 and can only be spent on acquiring open space, will be used for the purchase. No additional taxes need to be raised to make this purchase.
There is a desire from both the seller and the City to add a restrictive covenant that will prohibit future development and protect the land as open space. This strategic acquisition will effectively extend public lands from Hinckley Park to the Cape Elizabeth town line, and nearly to Fickett Street. The land will add significant recreational value for the public and this purchase will also be instrumental in supporting the City's compliance with Land and Water Conservation Fund program requirements at other sites throughout the City via Section 6(f)(3) of the LWCF Act.
