
Who Has to Comply?
- Non-residential building with 5,000 square feet or more of gross floor area that is located in the Village Extension, Broadway Corridor, and Mill Creek Core zoning districts
- Residential building with 10 or more dwelling units that is located in the Village Extension, Broadway Corridor, and Mill Creek Core zoning districts
- Residential apartment complex with 10 or more units that is located in the Village Extension, Broadway Corridor, and Mill Creek zoning districts
- Municipal or school building with 5,000 square feet or more of gross floor area
List of Covered Properties
In partnership with the Assessor's Office, the Sustainability Office has developed a list of all covered properties under the Energy and Water Use Performance Benchmarking Ordinance. The List of Covered Properties includes the Assessor's Map-Lot number and property location.
Exemptions
A waiver will be granted by the Sustainability Office for covered properties that meet one of the following conditions:
- Due to special circumstances unique to the applicant's facility and not based on a condition caused by actions of the applicant, strict compliance with provisions of this section would cause hardship
- An application for a permit to substantially remodel or demolish the facility will be filed not later than 6 months after the time of sale.
